General Terms and Conditions of Sale
SPECIAL TERMS AND CONDITIONS OF RENTAL
Buildinvest Group directly operates a tourist residence (hereinafter referred to as the "Residence") under the brand name "Résidence Océan et Forêt", offering furnished apartment accommodation services (hereinafter referred to as the "Apartment(s)") to individuals (hereinafter referred to as the "Guest" or the "Resident").
These General Terms and Conditions of Sale (hereinafter referred to as the "GTCS") apply to all reservations made at Résidence Océan et Forêt. Any reservation, regardless of the booking channel used, constitutes full acceptance of these GTCS.
Article 1 – APPLICABLE REGULATIONS
This agreement is governed by the legal framework applicable to French tourist residences (résidences de tourisme).
Accordingly, the Resident may under no circumstances establish the Residence as their principal place of residence.
The Resident may not rely on the legal provisions governing residential tenancy agreements, including those relating to the right to remain in the premises.
Any use of the Residence as a private or business address is strictly prohibited.
Article 2 – RESERVATIONS
2.1 Reservation Confirmation
A reservation at Résidence Océan et Forêt shall only become valid once it has been accepted by the Residence.
The Residence reserves the sole and absolute discretion to accept or decline any reservation request.
A reservation becomes final only upon receipt of full payment.
Non-Flexible Rates
For non-flexible rates, full prepayment of the total stay is required at the time of booking.
Such payment is non-refundable.
Flexible Rates
For flexible rates, a deposit is required at the time of booking as follows:
- 30% of the total reservation amount upon confirmation of the booking;
- The remaining balance must be paid 7 or 14 days before arrival, depending on the season.
Stays exceeding 28 consecutive nights are not permitted.
A digital check-in and check-out inventory inspection will be carried out jointly by the Residence and the Guest using a dedicated application.
2.2 Personal Use
The Guest declares that the reservation is made exclusively for personal purposes.
The Guest further acknowledges that:
- the reservation is personal and may not be assigned or transferred to any third party, whether free of charge or for consideration;
- the Guest is solely responsible for selecting the accommodation and services booked;
- no commercial, professional or business activity may be carried out within the Apartments.
2.3 Illustrations and Photographs
The Guest acknowledges that photographs taken with wide-angle lenses may alter the perception of the size and proportions of buildings and apartments.
All illustrations, drawings, photographs and images appearing in our brochures and/or on our website are provided for illustrative purposes only and are not contractually binding.
Article 3 – PRICES
3.1 Rates
All prices are expressed in Euros (€) and include all applicable taxes (VAT included).
Any subsequent change in the applicable VAT rate or the introduction of new taxes affecting the services provided between the publication of the rates and the invoicing date shall automatically result in a corresponding adjustment of the total price.
3.2 Included and Optional Services
Our rates always include:
- accommodation;
- water;
- electricity;
- heating;
- standard occupancy charges.
Guests are reminded that they are responsible for maintaining valid personal liability insurance covering any risks arising from their occupation of the Apartment.
Certain optional or additional services are not included in the accommodation rate.
Please refer to the public price list available on our website together with the provisions below.
Housekeeping Services
Accommodation rates include:
- weekly housekeeping;
- cleaning of the Apartment (excluding the kitchen and dishes);
- replacement of bed linen and towels;
- final cleaning at the end of the stay.
Additional Services
Unless expressly included in a promotional offer, additional services (including extra housekeeping, late check-in and similar services) will be charged separately.
Promotional Offers
Promotional offers are subject to the specific conditions communicated with each offer.
Promotional offers cannot be combined with any other promotion.
Rate Changes
Résidence Océan et Forêt reserves the right to modify its prices in the event of legislative or regulatory changes resulting in price variations, including changes to existing taxes or the introduction of new taxes.
Any legally imposed tax introduced or amended by the competent authorities shall automatically be reflected in the prices applicable on the invoice date.
Tourist Tax
The tourist tax (city tax) is not included in the accommodation rates.
It currently amounts to €3.74 per adult per night, although this amount may vary according to local regulations and the official classification of the Residence.
Depending on the booking conditions, it must be paid either:
- upon booking; or
- upon arrival during check-in.
Guests acknowledge that the applicable tourist tax is determined according to the legislation in force on the dates of the stay rather than the booking date.
Consequently, the amount payable may change between the reservation date and the arrival date.
"From" Prices
Prices displayed with the wording "From" are indicative only and apply to specific stay durations and travel periods.
Baby Policy
Accommodation is provided free of charge for children under two (2) years of age, provided their presence has been declared at the time of booking.
Baby equipment (baby cot, high chair and baby bath) is available upon request at Reception and subject to availability.
Article 4 – PAYMENT TERMS
4.1 Payment
All invoices must be paid in full prior to the Guest's arrival and before the commencement of the stay.
4.2 Security Deposit
Résidence Océan et Forêt reserves the right to require a security deposit as a guarantee against any material damage, disturbances or other nuisances caused during the Guest's stay.
Depending on the size of the accommodation, the amount of the security deposit shall range between €150 and €350.
The security deposit will be refunded within ten (10) days following the Guest's departure, provided that:
- the check-out inspection has been completed;
- no damage has been identified during the inspection; and
- all outstanding amounts due have been paid in full.
Article 5 – MODIFICATION OF RESERVATIONS AND LENGTH OF STAY
Subject to availability and at the sole discretion of Résidence Océan et Forêt, the duration of the stay may be extended without any obligation to provide the same Apartment or maintain the original accommodation rate.
Any stay that has commenced, been interrupted or shortened shall not give rise to any refund, including in cases of force majeure.
Any modification to a reservation made through a third-party booking partner (particularly via online travel agencies) must be processed exclusively through that partner.
Article 6 – CANCELLATION / NO-SHOW
6.1 Cancellation
6.1.1 Non-Refundable Rates
Reservations made under non-refundable rates are non-exchangeable, non-refundable and non-modifiable.
Accordingly, regardless of the cancellation date, Résidence Océan et Forêt shall charge cancellation fees equal to 100% of the total amount of the booked stay.
Any optional services booked and invoiced shall also remain non-refundable.
6.1.2 Flexible Rates
Flexible-rate reservations may be cancelled free of charge up to 7 or 14 days before the scheduled arrival date, depending on the applicable season.
After this deadline, 100% of the reservation amount shall be charged as a cancellation fee.
Where cancellation is submitted in writing, the effective cancellation date shall be the date on which the Residence receives the written notice.
Any cancellation relating to a reservation made through a third-party booking partner (particularly via online travel agencies) must be processed exclusively through that booking partner.
6.2 No-Show
6.2.1 Non-Refundable Rates
Reservations made under non-refundable rates are non-exchangeable, non-refundable and non-modifiable.
If the Guest fails to arrive on the scheduled arrival date, Résidence Océan et Forêt shall charge a no-show fee equal to 100% of the total amount of the reserved stay.
Any optional services that have been booked and invoiced shall not be refunded.
6.2.2 Flexible Rates
Guests who fail to arrive on the scheduled arrival date without prior cancellation shall be charged a no-show fee equal to 100% of the total amount of the stay.
6.3 Interrupted or Shortened Stays
Any stay that has commenced and is subsequently interrupted or shortened shall not be eligible for any refund.
Article 7 – HOUSE RULES – GUEST OBLIGATIONS
7.1 House Rules
The Residence's House Rules are displayed on the premises.
Each Guest is deemed to have read and accepted them.
Guests undertake to keep all furniture, fixtures and equipment provided in the Apartment in good condition and must immediately report any defect or malfunction to Reception.
Guests are reminded that all access points to the Apartment (including sliding doors, windows and the entrance door) must be securely closed whenever leaving the premises.
Résidence Océan et Forêt shall not be held liable for any consequences arising from a Guest's failure to comply with these House Rules.
The Residence reserves the right to enter Apartments in order to:
- carry out housekeeping services;
- inspect the general condition of the accommodation;
- perform technical maintenance;
- ensure compliance with safety requirements.
Failure to comply with the House Rules, or any behaviour contrary to public order, public decency or generally accepted standards of conduct, may result in the Guest being required to leave the Residence immediately, without compensation or refund, even if payment has already been made.
Résidence Océan et Forêt also reserves the right to file a complaint or report any such behaviour to the competent authorities where appropriate.
7.2 Occupation of the Apartment
The Apartment shall be made available to the Guest in good condition.
Guests agree to use the Apartment and all its facilities responsibly and without causing any damage.
An inventory is provided in each Apartment.
Guests must verify the inventory and the general condition of the Apartment upon arrival and report any discrepancies, missing items or damage to Reception within four (4) hours of check-in.
Upon departure, the Apartment will be inspected by Résidence Océan et Forêt.
Any missing inventory items, damage or deterioration shall be invoiced to the Guest or deducted from the security deposit paid upon arrival.
The Residence also reserves the right to access the Apartment whenever necessary for maintenance or safety purposes.
Each Apartment has a maximum occupancy limit which must be strictly respected.
Children aged two (2) years and over are counted as full occupants.
Any occupancy exceeding the maximum authorised capacity shall automatically be refused.
If an Apartment is occupied by more persons than its authorised capacity, Résidence Océan et Forêt reserves the right to terminate the stay immediately and require the Guest to leave the premises without compensation or refund for the remaining unused portion of the stay.
7.3 Minors
Résidence Océan et Forêt is not suitable for accommodating collective or individual stays by minors under the age of eighteen (18) who are not accompanied by their legal guardian(s).
The Residence reserves the right to refuse access to any Apartment booked in breach of this requirement and to cancel the reservation of any unaccompanied minor presenting at Reception.
In all circumstances, minors remain under the sole supervision and responsibility of their parent(s) or legal guardian(s) throughout their stay.
Article 7 – HOUSE RULES – GUEST OBLIGATIONS (continued)
7.4 Pets
Pets are welcome at Résidence Océan et Forêt, subject to the following conditions:
1. Prior Notification
Guests must inform the Residence of the presence of a pet at the time of booking.
Only one (1) pet per apartment is permitted.
2. Proof of Vaccination
The pet owner must present valid and up-to-date vaccination records upon arrival at the Residence.
3. Behaviour
Pets must be well-behaved and must not cause any disturbance, including excessive noise, aggressive behaviour or any nuisance to other Guests.
4. Supervision
Pets must remain under their owner's supervision at all times.
Pets may not be left unattended in the Apartment under any circumstances.
5. Breed Restrictions
Dogs classified under Category 1 or Category 2 pursuant to applicable French legislation are not permitted within the Residence.
An additional nightly fee will be charged to cover the extra cleaning costs associated with accommodating pets, in accordance with the Residence's applicable pricing policy.
Pet owners shall be fully responsible for any damage caused by their pet to the Residence, its Apartments or its facilities.
Résidence Océan et Forêt shall not be held liable for any injury sustained by a pet as a result of third parties or the Residence's facilities.
7.5 Wi-Fi Access
The Residence provides complimentary standard Wi-Fi access enabling Guests to connect to the Internet.
Guests undertake not to use the information technology resources provided by the Residence for any unlawful purpose.
Guests must comply with the Internet Service Provider's security policy, including all rules governing the use of security measures implemented to prevent unlawful use of the network and computer systems.
Guests shall refrain from any action that could compromise or interfere with the effectiveness of such security measures.
Article 8 – LIABILITY
Except where liability arises from the proven fault of the Residence established by a final and binding court decision, Résidence Océan et Forêt shall not be held liable for the loss, theft, damage or misplacement of Guests' personal belongings, whether occurring within the Apartments, common areas, car parks or any other facilities belonging to the Residence.
As this accommodation agreement is governed by the legal framework applicable to French tourist residences, the provisions of Articles 1952 et seq. of the French Civil Code, relating in particular to hotelkeepers' liability, shall not apply.
Résidence Océan et Forêt shall not be held liable for any disruption, interruption or inability to perform the accommodation services resulting from force majeure or unforeseen circumstances, including but not limited to drought, flooding, oil spills, general interruptions to electricity, gas or water supplies, strikes, construction works or similar events.
Guests remain responsible for the security of their accommodation throughout their stay and are encouraged to obtain any insurance coverage they deem appropriate.
Within the Residence, Guests are expected to behave reasonably and respectfully towards staff members, other Guests and the Residence's facilities.
Failure to do so may result in immediate expulsion from the Residence.
Article 9 – FORCE MAJEURE AND RELOCATION
Neither Résidence Océan et Forêt nor the Guest shall be liable for any failure or delay in performing their respective obligations where such failure or delay results from an event of force majeure, as defined by Article 1218 of the French Civil Code.
It is expressly agreed that the occurrence of a force majeure event shall suspend the performance of the respective obligations of both parties, each party bearing the costs resulting therefrom.
Where a force majeure event occurs, Résidence Océan et Forêt may be required to modify all or part of the services offered.
Services that cannot be provided shall not be invoiced; however, no compensation or damages may be claimed by the Guest.
Should one or more Apartments become unavailable, whether due to force majeure or any other exceptional circumstance, Résidence Océan et Forêt shall use its best efforts to relocate affected Guests, either wholly or partially, to a nearby hotel of an equivalent category providing similar accommodation services.
The costs associated with such relocation shall be borne by Résidence Océan et Forêt.
No compensation or additional indemnity may be claimed by the Guest in connection with such relocation.
Furthermore, the Residence accepts no liability for any complaint relating to the facilities, characteristics or services provided by the replacement accommodation.
Article 10 – TERMINATION – SANCTIONS – NON-RENEWAL
This agreement shall be terminated automatically, without prior notice or formalities, in the event that the Resident fails to comply with any of their contractual obligations or engages in behaviour likely to disturb the comfort, safety or peaceful enjoyment of other occupants.
The Resident shall immediately vacate the premises and may, where necessary, be removed with the assistance of the competent public authorities.
Article 11 – COMPLAINTS
Our on-site team is available throughout your stay to handle complaints, resolve any issues encountered and ensure that you enjoy your stay to the fullest.
Guests are encouraged to contact Reception immediately should any issue arise.
Following departure, any complaint must be submitted within two (2) days after the end of the stay by either:

We draw Guests' attention to the fact that delays in submitting complaints may make it more difficult to investigate and resolve the matter satisfactorily.
To facilitate the processing of your request, please include:
- the name under which the reservation was made;
- the reservation number;
- the dates of your stay;
- the Apartment type booked; and
- any supporting documents relevant to your claim.
Article 12 – INTELLECTUAL PROPERTY
Résidence Océan et Forêt shall remain the exclusive owner of all intellectual property rights relating to any studies, drawings, plans, models, prototypes or other materials created in connection with the provision of its services.
Accordingly, the Guest shall not reproduce, copy, distribute or exploit any such material without the Residence's prior written consent, which may be subject to financial compensation.
Photographs displayed on the website and in promotional materials are provided for illustrative purposes only and are not contractually binding.
Although every effort is made to ensure that photographs, illustrations and descriptions accurately represent the Residence and its accommodation, variations may occur, particularly as a result of furniture replacement, refurbishment or renovation.
No claim may be made by the Guest on these grounds.
Article 13 – APPLICABILITY OF THE GENERAL TERMS AND CONDITIONS OF SALE
Any reservation made with Résidence Océan et Forêt constitutes full acceptance of these General Terms and Conditions of Sale (GTCS).
These GTCS shall remain applicable for as long as they are published on the Residence's website www.residenceoceanforet.com and may be amended or supplemented at any time by Résidence Océan et Forêt.
Any revised version shall become effective immediately upon publication online.
The Guest's acceptance of these GTCS and of the conditions applicable to the selected rate is confirmed upon completion of the reservation process.
The Guest acknowledges having received these GTCS prior to making the reservation in a clear and understandable manner.
Where the reservation is completed online, the Guest confirms having read and accepted these GTCS by selecting the dedicated acceptance checkbox before finalising the booking.
These GTCS, together with any applicable Special Conditions, constitute the entire agreement between the parties.
No other terms or conditions communicated by the Guest shall apply.
In the event of any inconsistency between these GTCS and any applicable Special Conditions, the Special Conditions shall prevail solely with respect to the relevant obligation.
Guests may save and print these GTCS using the standard functions available in their web browser or computer.
